I don't think it is...
I think the problem is that patents are awarded for things that patently (!) should not be patented.

In this particular case I think the patent is wrong & the UK court is right.

The thing is its cheaper for governments to let the litigants battle in court after the event than fund their patent offices. Its not an easy one square off either as its a tax hit (on all citizens or corporations) or its the little guy having to take corporations to court.

I have no idea of the figures on sucess rates of individuals vs corporates... but low I'd suspect.
