I don't think they wanted overseas protection
I think they went the patent route because a certain company in Redmond, Washington is making noise about entering the online music and portable music player business -- a company notorious for "tweaking" the best UI and flooding the market with a barely-good-enough imitation in order to drive the innovators out of the market.

Any benefit Apple gains in Europe is ancillary.
