I don't think that was the point
I think JohnQPublic understands that -- the point was *should* it work that way? One camp might argue that the government only should help compensate your losses when your use of something public is affected by the government's actions. Another camp might argue that if the government imposes a loss on you, they should make it right regardless of the details. I think in this case the second camp was outvoted by a coalition of the first camp and the camp which thinks that if you can afford cable, you are evil wealthy scum who should count himself lucky that he is allowed to keep anything.

And to JohnQPublic, I saw an interview with a Time Warner exec in the last few days where it was stated that they would do something in the way of rebroadcasting digital channels in analog over the cable, so that one would still be able to get by without a set top box. It didn't sound like they had necessarily worked out the details of downconverting HD signals, etc.
