Glass houses...
Those who publicly walk around with their electronic toy in use, needs to be arrested, IMHO. Then maybe judges will sent them off to cell phone or mp3 player-rehab clinics for their device addictions.
Beware, lest your favorite device wind up on the prohibited list. IOW, "People who live in glass houses should not throw stones."

That being said, I walk frequently with a headset and music. I have never had the music up so high that I could not be situationally aware. Running a device so loud that one cannot hear the outside world (and I have seen this many times, /especially from motorists/) is far more dangerous than someone walking about with a MP3 player or other such device, who is not using it at excessive volume.

Besides, some of my best story ideas come whilst I'm out walking toward a store or the like. Banning the iPod would not bother me, but banning all such devices? Decidedly would. Why? I use an MP3 player that also happens to be voice-recording capable to record those ideas. Ban the device, and I'd be back where I started. Losing ideas before I got back to record them.

This is worse than a slippery slope, though. It is more a Teflon cliff. If this law is passed, then God help us all as the rest of the lawmakers jump on the bandwagon and lead us to the path that bans everything worthwhile.
