Exactly and then some!!!

It is called probable cause or a reasonable suspicion in some parts. Once a suspect is observed they would have been sending out some reasons even as simple as odd behavior or disorderly conduct. The alcohol/drug impairment would be considered along with the disorderly conduct. Not enough evidence to support the alcohol/drug impairment, lock them up for the disorderly conduct.

Those who publicly walk around with their electronic toy in use, needs to be arrested, IMHO. Then maybe judges will sent them off to cell phone or mp3 player- rehab clinics for their device addictions.
