If someone is walking around under the influence of drugs or alcohol you probably would not think twice for a speedy arrest.

Usually the person under the influence has to do something besides just being high to be arrested, how else would you know that they are high? If the person is merely high and not causing any problems I don't see the harm. If the alcohol causes them to do something wrong then yes, but I don't believe that an iPod has the same effect as alcohol on a person. This person probably would have done the same thing (hit by bus) whether he was listening to music or not. These things happened often enough well before the iPod or even the Walkman were around.

And really, how do we know that the guy didn't WANT to be hit by the bus?
