Ballmer, Zune, Ligitimacy
Ballmer is fast becoming the Microsoft president who is unable to make any money without using monopoly power. Plenty of folks try to make Ellison and Jobs out like they are Ballmers or Gates. But lets face it. Larry and Steve have products that make it in the market place without the use of Abramoff-style methods and without monopolistic preditory pricing as we see with Xbox and soon Zune (an extention device for Xbox).

Add to that the recent FCC win over net nutrality (2 years at least from AT&T) and very little tolerance for poor executive performance and design-by legals at national treasures like Microsoft should be given. Large companies like Microsoft can compete fairly; their executives and legel representatives have protested to much. (I can't believe that lectures I produce myself are deleted after two listenings on Zune - what a bozo design-by-legals that represents. Fire Smith. Argh!

I suspect that Ballmer really needs a ligitimate win about now. He actually has one if he wants to take credit for it. The

Novell-Microsoft marriage was a win for Microsoft as well as Novell and all the banks that snapped up Linux coupons from Microsoft so they could monitor network trafic with nagios - or whatever the reason - benefit.

Ballmer - here is a task for you if you want to ligitimize your presidency. Negotiate for more SUSE Linux from Novell. Microsoft shareholders care little about abandoning Vista as long as you are making money for them. Barney, now Zune, likely Vista. Come on. You need that ligitimate Linux win on your track record. Let go of Alchine, Smith, Gates. Microsoft does not exist to protect them or you.
