That's not the question... I said...
What if the patent company is just guessing...

Let's take the example of the carburetor. Suppose a company (company A) guesses that making a certain hole larger might improve the performance, so they patent it. Don't make anything... Don't test it.... Don't even try to produce it (they have money and everything)

A year later a company (company B) develops a new carburetor that gets over 100 MPG by increasing the size of the same hole, but it also has to be a specific shape.

Should company A be able to sue company B for patent infringement?
(they wouldn't if I ran the country)
