a patent doesnt make it illegal for you to manipulate a product, thats what liscencing agreements are for, ex. when you buy a product and they give you the legal stuff to read that nobody does.
They can print all the legalease they want, but you need to agree to it before the fact for it to be enforcable. Or, they have to provide a full refund if you disagree and anyone who has ever tried to return a SW product they opened but never used for a refund knows how futile certain vendors make that experience. Turns out there are laws which protect the consumers from abuse, but, you have to have deep pockets to enforce your rights. That's why class-action is in certain vendors future!

Exactly. We agree. There are also other tricks like using encryption in combination with the DMCA to make it illegal to sell non MS approved SW on the XBox and soon, coming to a store near you it will be illegal to run non-MS approved SW on uyour trusted PC. Can you imagine the heat that strategy will draw when its impact becomes obvious to Joe Sixpack and his "PAC Funded" representitives?
and about the drivers, you can write all the drivers you want, but if you sell it and you use the scheme that microsoft lays out, then you are infringing. personal use is what the name implies, personal use. how many people have been sued for modifying their xbox (not including anyone who has sold it)?
