the judge said pending the court case with IBM.
This puts further pressure on SCO to come up with the goods. (like one line of infringing code).

At the end of the day, SCO is claiming IBM broke it's contract by putting Unix code in Linux.
To date, SCO have failed to produce any evidence.
Now SCO are asking for more time (for the umpteenth time).

IBM have given SCO's lawyers (SCO is banned from seeing it) AIX code to try to find anything infringing.

My guess is IBM wouldn't have handed it over (I don't think there was any court order to hand over the code - after all fishing expedition's are not possible in the legal system) unless IBM were damned sure the code hadn't made it into Linux.

So this is the end of SCO.
Unix System V will live on in AIX until IBM retires it, and it seems like IBM is far more interested in selling Linux to new deployments (IBM has an ancient AT&T contract for AIX that SCO can't tear up). It looks like Sun's Solaris is in a tailspin in the market, so this is the end of Novell's Unix System V also.
Unix will live on in BSD versions of course, but they are elusive compared to Linux.
