Hurd has operational control of the compay
Either Patricia Dunn, as chairman, was running a independent investigation, or she had the active cooperation of HP management. In the unlikely event that Mark Hurd was completely bypassed, it would be his duty to resign (no CEO can afford to undermined in that fashion). I have to believe that HP managemnent were involved in at least some aspects of the investigation and that this involvement had at least the knowledge and cooperation (if not approval) of Mr. Hurd, who as president, is responsible for supervising his managerial colleagues.
