If Hurd did not receive or send any emails then he MIGHT not be involved in the scandal (But it is worth further investigation). Just because he is mentioned as giving his approval by someone else does not mean that he did approve of the plan. Also, he may not have know how the process was to work, this might however still make him responsible.

You need more proof than an innuendo from someone in an email. You need a paper or electronic trail back to Hurd. Yellow journalism at it?s best! Keep up the good work Washington Post, CNET.com and ZDNet News.
