Not exactly illegal, OR morally incorrect...
That attachment,..., is believed to have had the ability to track the e-mail, notify the sender if it was opened, and tell the sender if the e-mail was forwarded and to which IP address it had been forwarded.

Put an image on the web server that is ONLY in the email to Dawn, then everytime the email is opened, the image is fetched from the server and the IP is recorded. Search the web logs and you have a complete track of who and when the email was opened.

Salesforce.com uses exactly the same technique to check for opened emails.

Forget Linux / Windows / MacOSX being "comprimised", this is simple stuff.
