Quite the rebuttal!
Please. Go back and look at that lawsuit. eMachines' copying was well beyond just using a transparent case. And the courts agreed with Apple.
So if the courts agree with Creative (or Apple settles), will you backtrack and say that this case had merit? Will you admit that Creative isn't just doing this because they've given up on the market and are just looking to make one last buck? I'm not saying that you specifically do this because maybe you agree with every single court case outcome in existence but there is this interesting tendency to say "it must be right because the courts say so" when the judgement is in "your" favour but just as quickly say "our justice system sucks!!" when the judgement goes against what "you" wanted (and I put "you" in quotes because I'm not talking about tic specifically). Eolas's lawsuit was frivolous (IMO) but MS still caved. The end result of a suit is hardly a good measure of the frivolity of that suit.
The suits are very different. One defended a very specific design that was directly copied. The Creative one is trying to claim a common practice (which dates back to Apple's Lisa II) as a new and patented idea.
Your whole slam against Creative is that this hierarchical menu system has existed for a long time. First, if I was playing devil's advocate, I would argue that this patent covers the look and feel of a specific type of hierarchy on a specific device. I won't though because, as I've admitted, this suit is silly. However, Apple did the exact same thing with transparent cases. Like hierarchical menu systems, transparent containers had been around forever! Please reread my post. I wasn't saying that Creative's suit had merit (using the layman's concept of merit), only that Apple's suit didn't have merit (again, using the layman's concept of merit). Obviously the Apple suit did have legal merit just like, perhaps, the Creative suit has legal merit too. I still smirk about you desperately defending Apple for doing the exact same thing you accuse Creative of doing. If you had immediately admitted that Apple was silly to sue eMachines, it would have ended there.
Why does it only catch your eye when I defend Apple? How blinded are you by your own biases?
I sincerely apologize if that is the impression I gave. I did admit that my post was a bit trollish. I do honestly respect your stance on iTunes. However, let me turn this around and ask you why you assume that I only attacked your post because I thought you were a zealot? I "attacked" (if you want to call it that) your post because of what you said in that post and only because of what you said in that post. If it would put this thread back on track, I'll take back my points #2 and #3. They were there for the humour only.
tic, you and Laff are about the only 2 OSX users that show any signs of intelligence in these talkbacks. Don't think that it has gone unnoticed.
