The court isn't protecting criminals. It's defining the Web sites as journalistic entities and upholding their right not to reveal sources. Did the leaker violate an NDA by releasing information? Quite possibly.

But recognizing that a free press is important and given the changes in technology and information distribution, the court was correct (IMHO) to block Apple from acquiring their records. It may be that the news content is trivial (I think so; Apple may make insanely great products or may not, but they have never impressed me as a company). That's nothing something to be taken lightly, though. When the government starts taking away the tools of the fourth estate in whatever shape or form, it's the thin edge of the wedge.

There have always been evidentiary limitations; this is one that has been extant for quite some time. If Apple doesn't like it, too bad. They'll have to make their case some other way or accept that they can't. They may be in the right here, but I don't have much use for anyone throwing their financial weight around just because they can.
