Am I reading you right?
Note that Apple's application came after they were made aware of Creative's so perhaps it was an attempt to defend themselves from a frivolous lawsuit such as this one.

You are suggesting that after Apple found out that Creative had a patent for this system, Apple tried to file the exact same patent to protect themselves from Creative's prior art? Odd logic.

If not, they're just as wrong as Creative. I'd have to see the patent to know, perhaps it's more of a technological solution, given the "automatically files tracks" part of it.

I don't know. The article I linked to was from Sep. 2005 and I didn't see anything about Apple appealing the rejection though if you know of such an appeal, it would lend credence to your argument. It would appear that Apple didn't do their homework and will now have to pay for it. You know that Apple sues everyone who infringes on their patents. Why would other companies give Apple a break on this one?
