I'll tell you what wrong.
Creative somehow got a patent for a menu structure that has been around since the original Mac, and seen on many other products, applying it for a Music Player.
I would not agree with Apple or anyone else patenting this particular feature, either (as obviouis as it is).
It's kind of like trying to patent, using numbers to navigate temperature controls in personal submarines (new place, same thing).

There is nothing innovative or inventive about it.
Creative is only suing now, because they realize they have lost the MP3 player war, and are trying one last bid to get market share.
