flawed analogy

Except in this case, you ARE buying a product (an XBox2 without a hard drive), not licensing it. If they choose not to put a hard drive in it (for whatever reason) that is there choice, and you don't have to buy it if it doesn't meet your needs. It would be a different matter entirely if they sold it WITH a hard drive and had some legal method to prevent you from using it for your own purposes. They CAN'T do that with hardware, so their only solution is to remove the drive itself. Nothing can prevent you from modding the new box and adding one if you are capable of doing so; after all, it would be YOUR hardware (without a warranty, of course, which is the only legal thing they can do to you).

The analogy is more like, you bought the latest model of a car, and discovered it no longer had the onboard computer in this latest model. Of course you cannot transfer the "license" to another buyer, because the car does not have one. But you could have one added aftermarket and sell it with the car, if you so choose, although the dealer won't support it.
