why are they not taking out patents and then suing some company for Billions in 5 years time when the idea is used by accident in a new product


If only they could do it that way. Back in my days with IBM, they made us sign an agreement that our heads and everything within belonged to the company, if it was even remotely job-related. IBM had to get first dibs at patentable stuff. I invented something (5,553,225) and had to assign it to IBM. Got a nice framed certificate out of it! The same probably applies to every other company.
