I?m not sue why you included the reference to new use patents in your response to my post. I?m fully aware of new use patents, Viagra, ASA for thinning blood, AZT for Aids, yadda yadda yadda, they have been plenty of new use patents given out for some very worthwhile products. And your point is in relation to the RIM case? We are not talking about a new use patent situation here.
What is your point about China thieving patented technology form other countries? True, RIM is a Canadian company and NTP is U.S., I really don?t think we are talking about the kind of blatant patent thieving you seem to be alluding to that goes on at times. RIM is a respected company that is fighting the case in U.S. Courts. They have already shown the patents existed in Europe prior to NTP receiving them. This case has nothing to do with China.
I?m sorry you didn?t like my analogy about the wheel. I thought it was rather good in that it put the issue of; novel invention vs. obvious invention vs. first to the patent office. Let me give a real life example if you will then.
When it comes to gun manufacturing some of the most important developments in the evolution of the "gun" through the stages of the "matchlock", "Wheelock" and "flintlock" eras were developed by unknown inventors. While some rumours abound as to who might have created what when it is apparently pointless as there appears to have been inventors working in many areas of the world all at once on precisely the same problems with guns. As a result there is evidence that what on one hand appeared to be truly unique and inventive solutions to these problems early hand guns suffered from, the solutions were not "unobvious" to any inventor trained in the art as the exact same solutions frequently popped up in different locations around the world in a very short interval making it impossible to figure out who invented it first, and even more, its rather pointless to care if it was that obvious to so many. Good thing many of these stages in development were not patented at the time or there would have been quite a massive international debacle in the courts. But if someone had of made the "RUSH" to the patents office with these so called unique developments, we would have been in the thick of it for sure.
What does your point about slowing down the patent approval process by many applicants have to do with the story at hand. I am fully aware of the efforts that can be made to extend the time frame and secrecy of a patented process through many tactics that can be used but the issue here has little to nothing to do with that and I?m not following how that is some type of rebuttal to my post? They ability to obfuscate the intentions of the patenting policies and process only goes further to show the system is broke. It certainly doesn?t counter anything I have ever said.
The one thing you did say that appears to have some relation to my post is the patent office has never held my point of view...what point is that? That a new invention must be unique and unobvious to a person skilled in the art? I imagine they have exactly that opinion or they are breaking the law. The only thing I contend is that the patent office is Ill equipped to handle many technical patents and do not know unique or novel concepts unobvious in the art in question all to often.
