Interesting logic - let's ignore the USPO rulings
The US Patent Office has to-date ruled in favour of RIM and has rejected NTP's claims. I suggest that a more intellectual point or question would be centered on how the judge is going to address the legality of the case given the Patent Office's decisions. The 'reasonable man' approach clearly sides with RIM - unless one assumes that a US company has been wronged by a big bad Canadian company - but that never happens in anything other than ilegal US softwood tarifs.
