That may be true, but...
...what happens when the patent office permanently invalidates those patents? Wouldn't that mean that RIM did nothing wrong? Legally, they would not get the settlement money back, since it would be a legally binding settlement and would probably not have any stipulations related to the outcome of the patent re-examinations. In such a case (and events seem to indicate that the things are moving in that direction), NPT would make lots of money for exactly nothing.

In my opinion, this 'workaround' is just another way for RIM to buy themselves some time. NPT will probably cry foul once they review the workaround and conclude that it doesn't infringe on their patents any less than the original system. While all this is moving through the courts, the patent office might issue a final ruling. After that is done, the game will be fair and square; pattents valid - NPT wins; patents invalid - RIM wins.
