In the case of NTP, however, the inventor did implement his invention and was paid for it. The problem is that it never hit the market because AT&T dropped him as a vendor.

With that said, I agree that the process needs to be changed. The patent holder must prove that the design is more than just a "brain storm". There must be proof of a valid implementation attempt. This attempt might be a success or a failure, but records mush show a "real-world implementation strategy." Without such proof, there should be no case.
