In your utopia world of protecting the little man, yes, patents protect intellectual property. But to suggest that the patent system isn't in complete need of overhauling or that RIM simply blatantly ignored all patents and produced the product is vastly overstated. Do you know when RIM and it's founders created the idea for the Blackberry? How about when NTP's "idea" was created?

The simple fact remains - the patent system needs to be overhauled. A company that can patent an idea and then do absolutely nothing to actually achieve that technology, but rather sit back and wait for someone to actually create the technology and then wait for the market to get so big AND THEN file a claim is just ridiculous - patent an idea and then DEVELOP it, if not, lose it. NTP clearly waited for RIM to build the technology, create a huge market for the product, then when they knew it was ripe for the picking, the are extorting money from them by asking for a larger settlement then what is considered an industry standard practice. If they simply wanted to charge an industry standard type of royalty, then this suit would have been settled years ago - as is the case with MANY of RIMs past patent issue.
