Skype is encrypted in 256-bit AES
Skype behaves as a signing authority and each user generates their own Public and Private keys that are at least RSA-1024 if not more. Then the actual voice call is encrypted in AES-256. You can forget it even if it's only RSA-768 and AES-128, even for the NSA.

Looks like the policy will have to resort to good old fashion bug planting if they want to listen in.
