Devil's rebuttal...
Yes, just about any product is inherently dangerous. Knives, cars, etc. However, the iPod (and I wouldn't be surprised if it's really all MP3 players, but iPod has market share, so it gets the attention) the iPod is different from a knife in that it can be harmful if used as intended i.e. to listne to music through headphones. in addition, some studies have claimed that the earbuds which are supplied with the iPod contribute to risk because of the way they are worn so close to the ear drum.

Which brings us to the heapphone argument. No one can expect Apple to prepare for every headphone, however we can expect them to calibrate for the standard headphones - once you buy new headphones you've altered from factory spec, so you're on your own much like altering a vehicles tire size makes the safety stats on that vehicle obsolete. Anecdotal and sales evidence would indicate that most users do not upgrade their headphones anyway, in many areas those little white earbuds are considered part of the status of owning an iPod.

And the causes of hearing loss are not something I am familiar with, all I can go on is the OSHA standards. One would assume that those are conservative but as good a starting place as anywhere else.

All this being said, I hope the guy loses. It's a stupid lawsuit and that British system as described in the last post sounds great. Too bad we don't have as logical a system.
