That's silly
First of all, hearing damage is caused as much by frequency as
level. Higher frequencies cause damage at a lower level than
low frequencies (as my friend the former Navy radio operator
found out the hard way).

Volume controls are inherently inaccurate, being fully dependent
on the impedence of the output device. Plug the iPod, or any
other device into another pair of earphones and that level will
change. Plug it into speakers or something else and it will
change again.

As for marketing a device that MIGHT cause harm, think kitchen
knives. That's just one blatent example. Virtually EVERY product
has the potential for harm. Stick a QTip too far in your ear and
you can damage the eardrum. You get the picture.

The fact is that lawyers will troll for ANY sort of lawsuit because
there's little downside. The defendent gets stuck paying a
fortune to defend the thing and can only recoup that cost under
very limited and extreme conditions.

The Brits have a simple system. The loser pays the winner's
costs. Good lawsuits are quickly settled because the defenednet
does not want to end up paying millions extra in legal fees ON
TOP of the damage award. Bad lawsuits are discouraged by that
same thing. Until the US gets something like that, things will
only get worse and YOU and I get stuck paying for it.
Go to the Home Depot and buy a ladder for 100 bucks. $0
percent of that is for liablity coverage of the maker. Same thing
goes for power tools.
