Playing Devil's Advocate
Okay, this is a stupid lawsuit. However, I feel obligated to play Devil's advocate(someone ought to).

Isn't there something questionable about a company creating a product that when used properly causes permantent damage? Because, while there may be a warning in the manual, even the warning indicated that harmful volume levels "may sound normal but can be damaging to your hearing." Particularly since the volume indicator on an iPod is a gray bar, rather than any quantifiable indicator. It does seem a little irresponsible.

Is it enough for a lawsuit? Probably not. But there is definitely some lack of forethought on the part of the designers. How hard would it be to put a number indicator like those found on most stereos, televisions and even other MP3 players. If it's too difficult to match the number to actual decibel output(which my home stereo does), then Apple could easily put in their warning that prolonged listening over say level 25 is dangerous. It doesn't seem like this would have been a hard safety issue for Apple to avoid.

Okay, let the backlash begin, the Devil had been advocated for.
