you simply cannot have an agreement of a 'privacy policy wich declares the user aggrees of sending aggregate user information or else does not legally use the devices services.

This is much the same as the finality of that 'opt-in on email spam situation. The basis of the law would be to legitimize the influence of these types of user aggreements through a 'business basis. Just so the estabolisher of the agreement could not be affected to a reality of itself as spam would be included.

Supposing I had an agreement wich said 'you must receive spam in order to receive this service.

Of course nobody can see what I'm getting at. Zero Tolerence Privacy agreements.
