Stupid is as stupid does
We wont know the answer until more information comes out, so your rhetorical question seems premature. But your tone suggests that you think this is bad for the consumer.

If Intel is cheating and the reluctance of companies to reveal information is due to coercion, then the consumer wins by having all of this brought out into the open. So even if they do it for their purposes, AMD would be helping consumers. In that case, Intel needs to be made an example of.

If the claim proves frivolous then AMD will lose money, customers, and reputation and your rhetorical question may then have some merit (i.e., it would seem stupid of them to sue when they have no case). But I dont see that as hurting the consumer except in the usual "frivolous lawsuits" way.

In either case, I suspect its somewhere in between, so its still a good thing for the consumer. You have not made a case for why this is bad for the consumer (if that is your goal).
