I don't think it should be banned outright, but it should have very limited use, and there should be nasty laws discouraging its abuse.
I'd like to add once again that your "analogy" is really not one at all, and thus holds no weight whatsoever.
I'll take a cue from you and say that if you're so unhappy with the current state of IP, then start your own IP security company and fight the good fight yourself..;-)
