There are quite a few cases that are not settling and scrambling to be among the first to litigate the issue. They are being treated as pro bono by the groups supporting the individual being sued and they are likely to be the death of the RIAA once the judges start making rulings.

The RIAA is using the threat of large awards in the tens of thousands of dollars for legal fees and court costs to cower the file swappers who are really only doing a few hundred of dollars of swapping damage to the labels. In general, this is know as "abuse of process" and the RIAA will eventually come across a judge or two that will put them into contempt for doing so.

The day is coming when the labels and artists will need to create a whole new paradigm for music distribution. As of now, the labels are showing that they are largely unnecessary and exist only to promote an artist on their string into prominence by spending lavishly on promotions that they pay for by charging a lot for the finished product that they have worked into a demand.

The more modern form may be for the media channels, cable and networks, to generate their super stars much as the motion picture industry does now. They will need to recoup their investments by holding concerts on air and retrieving their costs from advertising revenues. TV production companies today do not have any problem with continuity of the art and they never had and never will have much in the way of personal media sales on DVD or CDs. The TV actors make as much money and are as popular as any singer today.
