If you owned it then there would be no restriction placed on it's distribution! It may not be the same licensing terms as Microsoft but it is a license to use not ownership.

No, you said it in your first sentence above. The restrictions are on the distribution. Then in your second sentence above you say the GPL is a licence to use. There are no restrictions on the use of Linux software.

It's not even that the GPL has "not the same licensing terms as Microsoft," because the Microsoft EULA isn't a license. It's a private contract between you and them in which you make promises to Microsoft in exchange for using its products. A license to use? When you buy a book do you need a license to read it?

Do you need a license to copy and distribute it? Of course you do! Same with Linux.

It's the law that says you need a license to copy and distribute, not Linux telling you so. So, when someone gives you a license for free to do that which otherwise would be illegal, but they have some ground rules for you to follow, you would characterize that as constituting "restrictions" on what you can do?

Compared to what? The purpose of Microsoft's EULA is to narrow your rights. There's no law that says you need a license to use Windows. There's a law that says you need a license to copy and distribute it, you bet! The EULA narrows your rights, the GPL enlarges your rights, or at least licenses rights you wouldn't have otherwise.

No, the difference between them isn't just their terms and conditions. They're two completely different animals.
