Remember the Timeline case?
Microsoft lost a patent infringement case on SQL server and then Timeline went after Cognos, a customer. Cognos settled for $1.75 million.

Cognos had no idea they were infringing, couldn't even see the code, but were still at some disadvantage.

Microsoft has since extended its indemnification, effectively covering almost everyone who can't change the Microsoft code for anything.


The point here was, courts can find someone liable for actions they didn't know they were doing. That definitely applies to GPL cases. Even if a company takes steps to assure that their code is sufficiently separated from the GPL'ed code, they can still get caught.
