So, speculation here and in any other given case until there are facts, but I think you can agree there's a real danger that will probably afflict some company some time.

The only danger I can see is that a court at some time perpetrates an injustice against an author of original code by declaring it to be a derivitive work.

But composers, screen writers and novelists face the same potential danger, should they find themselves in court fighting over the ownership of a work. It has nothing to do with the GPL.

What I do not see happening is that a court decides Person A is the original author of a certain bit of programming, and that it's not a derivative work, but they should lose their rights because it "connects," whatever you mean by that, to GPL code. That's just bunk.
