SCO case fundamentally different
The Real claims are, for the most part, publicly verifiable, that is, we can look at their claims and make reasonable conclusions about most of them.

In the SCO case, however, we have very little information of the substance of SCO's claims. Personally, I find it quite possible that an IBM programmer inserted SCO code into the Linux operating system. This was probably not intentional (ie. an intention violation of SCO's rights, not intentionally putting the code in there), nor (potentially) known by IBM management.

SCO's method to pursue recourse for these alleged violations has not been honourable, and indeed is probably just a cash grab. But that does not dismiss the validity of their claims.
