And yet

MS is near the top of the list of those pushing for software patents.

Actually, this makes sense. MS, unlike others, can afford to litigate their opponents into the ground. In the unlikely event that they still lose, they can throw a few hundred million at the winner (always assuming that they're still breathing) which may or may not cover legal costs.

It's to Microsoft's advantage to raise the cost of software litigation. That doesn't mean that it's to their advantage to pay out, mind; a billion saved is a billion earned. No, it's to their advantage to just raise the ante.
