it depends on how you define "based"

if you look at his post of "Much of the cde in Linux was directly lifted from Unix. It was is and will always be Unix based. No amount of symantecs will change that fact."
clearly he is sayign Linux is based on Unix, because it took much of the code. i also believe in anothe rpost, he said that Linus just created a port of Unix for x86. Both statements are patently false. The Linux Kernel Structure is very different from the Unix Kernel.
Code wise, they are not the same.

Linux was designed to create the same functionality as unix, but does not share the same code base. In the sense, that they try to achive the same goal, Linux is based on Unix, but not in the sense that Linux's code is based on Unix's code.
