How about a click-through license for standards in a similar way to GPL protects source.

I thought about this when looking at the SPF situation. Pobox put out a usable anti-spam solution, it was embraced-extended into a patent protected closed solution.

The same thing happened to Kerberos. It was 'extended' into a closed solution via trade-secrets. To get the information Microsoft required you to click through an EULA that would seek to prevent you implementing their extended version.

Wouldn't it be nice if this click through EULA cr*p could be used against the companies that seek to misuse them?

i.e. you have a mechanism that requires acceptance of a click-through license to obtain the RFC. That prevents patenting of derivatives of the idea, embrace-extend attacks, use of the trademark 'kerberos' in relation to non-compliant implementations of kerberos, requires disclosure of any prior patents that this RFC might infringes on, etc.
