Simple. You can sue for a lot more money once everyone is using it.
If they had sued someone as soon as their specious patent was "infringed", that would have been a heads up to the industry, who would have then devised other methods of accomplishing the same goal. And that would have made the patented "technology" in question completely worthless, period.
