What other products and ideas can have copyrights and patents?

It would seem to me that you get one or the other but not both. But since all is source code then it is just instructions and it should falls in the realm of copyright and not patents.

Patents should be for hardware.

At the same you could argue that patents apply to software as softare is tools to do a job in which case copyrights should not apply.
