CD-burning software prompts patent suit

Is there anything like this: What other products and ideas can have copyrights and patents?

It would seem to me that you get one or the other but not both. But since all is source code then it is just instructions and it should falls in the realm of copyright and not patents.

Patents should be for hardware.
