The way I figure it...
Perhaps, but a typical structural engineering job is 500-1000 GBP and thats with with 1 million GBP insurance cover to cover possible liability.

I don't see why patents are so much more expensive. *

With the extra checks in play, an inventor could launch their idea using normal non-disclosure (simply posting himself a copy to time stamp it and use the prior art defence against a patent claim). The extra penalties on the patent office would help reduce the mindless patent attacks so protecting him from mindless claims.

Sure its not an optimal solution but I don't see that we can have 'optimal' solution now that the patent staff have gotten their way and software is patentable.

*basically I think that, with a penalty against the patent office it creates a balance point. They can issue every patent at small cost but face high lawsuit charges, or they can issue very few at very low cost but get low income. Somewhere in the middle there would be a balance point between the two extremes where they cover their costs.
At the moment there is no balance, the patent office issues more patents, makes more money, so issues more patents to make more money...leading patent officers to want to patent everything all the time regardless of the damage they are doing to their countries.

Why software patent spam at all?  Nigel Johnstone | 03/11/05
It STILL leaves patents as a tool for the rich.  Judas I. | 03/11/05
Yes, or perhaps pay the penalty for defeat  Nigel Johnstone | 03/11/05
It's in the "DUH!" category, isn't it, Nigel?  Judas I. | 03/11/05
