Maybe that is the fix then. I use to work with a structural engineer. He would check the design of a building and certify that it would conform the the building codes and not fall down.
If the building failed *he* would be as equally liable as the original architect and as such had to carry significant insurance.

Maybe thats the fix for patents. Make the patent office equally liable for bad patents.

Just like all professional bodies, solicitors, lawyers, doctors, structural engineers, etc. are al liable for their own incompetence.

When big guy with bad patent but deep pockets attacks little guy, it wouldn't matter if the big buy has a lot of money - the patent office would still lose if defeated, so they would withdraw the patent.

Similarly for patent game companies vs big guys. The patent office would lose.

I think you'd also have to make it so that higher fees apply to patents that are granted than not granted, but maybe thats the solution.
