Yes, or perhaps pay the penalty for defeat
"If the U.S. government is going to grant a patent, claiming that it is some sort of protection for the little guy as far as his IP goes, then the U.S. government should pay the costs of defending it."

Maybe, or something similar, maybe they should pay the legal costs if the patent is defeated in court.

Afterall, by issuing the patent they are making a statement: "This is an invention, it is new and novel and non-obvious"

If that statement turns out to be incorrect, and they've accepted money for making it, maybe they should pay the legal costs of their mistake!?
