In Canadian Law you can lend a CD that you own but don't have the copyrights for to friend and they can legally copy it. You break the law when you copy that CD and give it to your friend.

So in P2P's case you anyone technically can copy the songs you have available and be completely legal.

Of course this just an argument that you can make in your defense if charged with violating copyrights. So it's not like it's legal but the defense could get off and set precident making it legal for others. That's why the CRIA isn't suing people in Canada. The defense is not as weak as the US fair use laws.

It works kind of like pawn shops. A pawn shop can legally sell you stolen goods even inf they suspect they are stolen. If you are caught with the goods you are guilty of possesion of stolen property. You have a good defense though if you have the pawnshops reciept or proof of purchasing it there. So cops don't bother going after you.

Now buy that same item of the back of truck in a dark alley. Differnt story.
