Here's how it works....
In Canada we have a system that argues home recording is essentially legal. That is, one is allowed to record to certain devices. We can legally tape TV shows off air for example for in-home use.

In return, every blank item of recording media (tape, CD etc) has a "levy" attached to cover the cost of such copying.

The body that answers key questions on copyright in Canada is a special tribunal called the Copyright Board. When it makes its rules these are generally written in stone and beyond any real challenge.

The Board has evidently extended the levy charge to cover the size of an MP3 storage/player's RAM.

Organized Music in Canada has tried to argue that the levy covers the cost of ILLEGAL (unauthorized) recording only and is not a compensation for recording that has been negotiated, and therefore does not imply downloading is legal.

It looks as though the Copyright Board has at least been stymied by Big Music's argument; critics of the Big Music rationale say it is not accurate, since having a "levy" that charges people for illegal recording and then implying that another real "license" (purchase) fee must still be paid amounts to "double-dipping"--essentially paying twice for the same thing.

In any event Canada will likely soon have its own DMCA-like law, and when that passes recording music to MP3 devices will become illegal anyway. So, oddly, Canadians will pay up tp $25 extra for players but won't be legally entititled to exercise this paid-for recording right!
