Fraud can be a felony
You ask very good questions and I agree with a lot of your logic. However, I have administered email systems and have seen business grind to a halt when someone misuses systems, networks and servers that do not belong to them -- and I think that is what this guy did. If he had sent the stuff from his own box on his own dime and did not attempt to misrepresent who was sending then there is no fraud. If I drove your car across the country and back, used your good name and credit without your approval would that be a crime? I tell people that I am you and misrepresented you then I bet you would not be happy and that is known in the tangible world as criminal impersonation. I used your resources but I didn't kill anyone, right?
