Notice the prior art
Eolas should never have been granted a patent so derivative of commonly used techniques.

The software world has rallied around Microsoft in this case and revealed their prior art, but the problem here is the patent was granted with no way to determine prior art.

Its not good blaming the USA Patent office, they had no way of seeing the algorithms in other peoples closed source software.

You can't have patents in a closed source world. You can't determine prior art and so companies get patents for things they didn't invent.

What happens when its a smaller more obscure patent and the software world doesn't come forward and reveal its code?
