This is open source in the sense that people have access to source code which they can use in development.

No, they can't use it in development. That's exactly the point. They can't modify it, they can't compile it. They can't even build binaries from it to verify that the source that they have actually corresponds to the binaries that they are running.

They also can't "use (it) in development" because anything that they develop based on it belongs to Microsoft by contract (work for hire).

That last, by the way, rather contradicts your "people who value" comment -- the only people whose work is valued under "Shared Source" are Microsoft, everyone else works for free.
