Really grasping at straws
I mean it's not released under GPL so then it's not really open source.

Well, if you ask Stallman and Moglen (who being the authors of the GPL have more right to an opinion than most) software released under the GPL isn't "open source" either, it's "free software."

Which means that according to Don, the set of all "open source" software is the empty set. There's a useful term now, hmmm?
